Charges Dropped Against TikToker Shot by Federal Agents in South LA
Judge Dismisses Indictment Against TikTok Creator Following Immigration Incident
LOS ANGELES – A federal judge has dismissed the indictment against TikTok creator Carlitos Richard Parias, citing significant procedural failures by the government. U.S. District Judge Fernando M. Olguin determined that Parias had been deprived of his right to counsel during his detention and emphasized the government’s repeated inability to release critical body camera footage related to the incident.
In October, Parias, known online as "Richard LA," was shot in the elbow by federal agents during a confrontation in South Los Angeles. This incident also resulted in a deputy U.S. Marshal being wounded by a ricochet. The original charges accused Parias of assault on federal officers after he reportedly rammed his vehicle into law enforcement vehicles while being boxed in by authorities.
Following the ruling, Judge Olguin expressed concern over the government’s failure to meet court deadlines and the implications this had for Parias’s right to a fair trial. The judge’s decision highlights the complexities surrounding law enforcement practices and accountability.
Parias has gained notoriety for documenting Immigration and Customs Enforcement (ICE) operations. His efforts in community reporting earned him a certificate of recognition from the Los Angeles City Council in August, a testament to his impact in the community.
Timeline of Events
- June 13, 2025: Parias encounters ICE while filming an arrest and is briefly detained before being released.
- August 2025: Councilmember Curren Price awards Parias a Certificate of Recognition for his citizen reporting.
- October 21, 2025: Federal agents surveil Parias, leading to a traffic stop where gunfire injuries him and a deputy U.S. Marshal.
- October 22, 2025: Parias faces charges of assault on a federal officer while in the hospital.
- December 29, 2025: The indictment is dismissed due to violations of civil rights and procedural failures.
Reactions and Implications
The case has ignited discussions between federal authorities and community advocates. Attorney Carlos Jurado characterized Parias as a "pacifist" who has faced targeting due to his social media activities, asserting, "What we know about Richard is that he’s a very calm man… it’s difficult to trust every word that comes from DHS."
In contrast, Acting U.S. Attorney Bill Essayli claimed Parias escalated a simple arrest into a dangerous situation by refusing to comply with agents’ orders. Additionally, the Office of Councilmember Curren Price hailed him as a "pillar of our community" and a "fearless citizen journalist."
As of now, while the indictment has been dismissed, it remains uncertain whether federal authorities will seek to refile charges. Parias continues to be held in administrative custody at an ICE facility in Adelanto.
