Blake Lively and Justin Baldoni Lawyers Explore Settlement Before Upcoming Trial
Attorneys representing Blake Lively and Justin Baldoni are initiating discussions regarding a possible settlement in the ongoing sexual harassment and retaliation lawsuit filed by Lively against her co-star and his associates connected with Wayfarer Studios. This lawsuit stems from allegations made last year during the production of It Ends With Us.
Despite the efforts to facilitate discussions, expectations for an early resolution remain low, particularly with a trial date set for May 2026. Both parties may find it challenging to reach a compromise before that date.
Notably, Lively and Baldoni are expected to meet directly during this process. Magistrate Judge Sarah Cave has emphasized the importance of the parties being present, stating, “The presence of each party (the client), in addition to counsel, is essential to the settlement process,” as noted in a December 18 order.
Lively is reportedly seeking approximately $500 million in damages from Baldoni and the Wayfarer team. Conversely, Baldoni intends to contest the allegations of misconduct that surfaced during the film’s production and address claims of a subsequent online smear campaign against him.
On December 9, Judge Liman postponed the trial, originally scheduled for March, due to a backlog of criminal cases in the federal court system. During the same session, he urged both parties to manage the situation without necessitating a trial.
Upcoming meetings are scheduled for January 23, where Lively’s legal team will convene separately with Judge Cave for a “counsel-only conference” to further discuss settlement options. In that session, Lively’s lawyers from Manatt, Phelps & Phillips will present first.
Judge Cave has set a timeline for settlement demands and responses, with Lively required to submit a settlement demand by January 28, 2026, and Baldoni’s team to respond by February 4, 2026. Following these communications, a comprehensive settlement conference will be held on February 11 in Judge Cave’s courtroom. This session will include both parties and their respective legal teams, providing each side an opportunity to present concise arguments regarding the case.
At this crucial settlement conference, both sides are expected to deliver a brief overview of their positions to facilitate discussions aimed at a resolution. After initial presentations, private discussions with the court will follow to address legal expenses incurred and projected costs through to trial and potential appeals.
If a settlement is not reached, the trial in May 2026 may involve testimony from not only Lively and Baldoni but also high-profile personalities, including Lively’s husband Ryan Reynolds, co-star Hugh Jackman, and Taylor Swift, among others. The proceedings could delve into digital evidence, social media analysis, and behind-the-scenes footage from IEWU, further shaping the narrative on both sides of the dispute.
